HONOURABLE SRI JUSTICE P.NAVEEN RAO Date: 22.08.2017 Between:

Kavali Jangamma W/o late Shankaraiah, Aged about 35 years, Occu: Agriculture, R/o. Mazidpur Village, Hayathnagar Mandal, Batasingaram, Ranga Reddy district.

.....Petitioner and The State of Telangana, rep.by its Principal Secretary, Stamps and Registration Department, Secretariat, Hyderabad and others.

.....Respondents The Court made the following:

HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims to be the purchaser of the land to an extent of Ac.4.00 guntas in Sy.No.1417 of Ammanabole Village, Narkatpally Mandal, Nalgonda district. Document was presented for registration on 07.01.2008, which was kept pending. On 29.12.2014, intimation was given to the petitioner refusing the registration of document on the ground that part of the land, which is shown as sale transaction, is surplus land and, therefore, document cannot be taken up for consideration. For the reasons best known, petitioner kept quiet and came before this Court with almost three years thereafter. Even now petitioner does not challenge the said refusal order. Petitioner did not avail remedy of appeal as available to her.

2.

The information furnished by the Tahsildar on 15.09.2016 is enclosed as Ex.P4 at page no.35 of the material papers. A bare look at the information furnished by the Tahsildar would show that some of the vendors, from whom petitioner claimed to have purchased the property, are in occupation of the land classified as ceiling land. Thus, prima facie, I do not see any error in the intimation given to the petitioner showing that portion of the land is classified as ceiling surplus land.

3.

If petitioner has any grievance regarding classification of the land or demarcation of the land classified as surplus ceiling land and other patta land, he has to work out his remedies as available in law.

4.

Writ petition is dismissed accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
