Kamera Rajam v. The State Of Telangana
HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.5438 OF 2019 O R D E R:
The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring the action of the Respondents in not entering the Sy No 455 land admeasuring at Ac0 15 Guntas situated Thgungur village Beerpur mandal jagtial District in the Newly issued pattedhar pass book to Petitioner in pursuance of Samagra Survey and also not depositing the check amount under Rithubandhu scheme by considering the petitionersRepresentation made to the 4th Respondent dated 08022019 and Representation to 3rd Respondent dated 11022019 as illegal arbitrary and contrary to law apart from violation of principles of natural justice besides violation of Articles 14 21 and 300A of the Constitution of India and consequently direct the respondents No 2 to 4 forthwith to enter the land in Sy No 455 admeasuring Ac0 15 Guntas in his New pattedhar pass book and in Darani Web site and also direct the respondents 2 to 4 to disburse the Rithubandhu scheme amount to the petitioner and pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."
Perusal of the record reflects that the Form 1-B information furnished to the petitioner incorporated his name against the land holding in Sy.Nos.384/3/2, 384/4/1 and 455 of Thungur Village, Beerpur Mandal, Jagtial District. However, the new pattadar pass book issued to him reflected his land holding in Sy.Nos.384/O, 384/GA and 464/3 of Thungur Village, Beerpur Mandal, Jagtial District.
The complaint of the petitioner presently is that despite his having made representations dated 08.02.2019 and 11.02.2019, the Tahsildar concerned is not taking steps to rectify the records. It would only be on the strength of a new pattadar pass book that the petitioner can avail the benefit of the Government's Rythu Bandhu scheme. That being so, it is not open to the Tahsildar concerned to remain inactive in relation to the discrepancies that crept into the new pattadar pass book issued to the petitioner. The representation dated 11.02.2019 bears the endorsement to the effect that the office of the Tahsildar received it on the very same day. The Writ Petition is accordingly disposed of directing the Tahsildar, Beerpur Mandal, Jagtial District, to take appropriate action on the petitioner's
representations dated 08.02.2019 and 11.02.2019 expeditiously and in any event, not later than 4 weeks from the date of receipt of a copy of this order, be it from whatever source.
Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
