THE HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO W.P.No.14432 of 2015

ORDER

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.

2. The petitioner is a partnership firm engaged in distribution of PDS kerosene in wholesale at Hyderabad and Ranga Reddy Districts. The petitioner is having B-Form license from the second respondent as well as from the Joint Collector, Ranga Reddy District. The petitioner is having storage points at both places. While so, the Deputy Tahsildar (Enforcement) in the office of the second respondent along with his staff inspected the premises on 25.04.2014 and asked the petitioner to submit the registers and licenses. Accordingly, relevant documents were submitted. The Deputy Tahsildar (Enforcement) submitted a report on 25.04.2014 to the second respondent. Based on the said report, after having registered a case under Section 6-A of Essential Commodities Act, 1955, the second respondent passed an order on 08.05.2015 suspending the license of the petitioner. Challenging the same, the present writ petition is filed.

3. Learned Government Pleader for Civil Supplies for respondents, on instructions, submits that the petitioner submitted its explanation and enquiry is scheduled on 08.06.2015.

4. In view of the nature of allegations mentioned in the impugned order, this Court is not inclined to admit the writ petition. However, since the petitioner has already submitted its explanation to the allegations mentioned against it, this Court deems it fit to direct the second respondent to complete the enquiry as expeditiously as possible and pass final orders within a period of 30 days from the date of receipt of a copy of the order.

5. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________________ A. RAMALINGESWAR RAO, J 4th June, 2015 sj
