THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5437 OF 2019 O R D E R :

This writ petition is being disposed of with the consent of both the parties.

This writ petition is filed for the following relief: ".........Writ of Mandamus declaring the inaction of the respondents in releasing the vehicle allowances of the petitioner from July, 2017 to September, 2018 an amount of Rs.4,23,000/- due to the petitioner is highly illegal, arbitrary..........."

Heard Sri Mohd.Ghulam Rasool, learned counsel for the petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that he is working as Tahsildar in the office of the 5th respondent and is entitled for vehicle allowance from July, 2017 to September, 2018 which amounts to Rs.4,23,000/-. The grievance of the petitioner is that though petitioner submitted bills, the respondent authorities are not releasing the above said vehicle allowance. Petitioner further contends that he made a representation on 08.01.2019 requesting the respondent authorities to release the vehicle allowance to which the petitioner is entitled to. But so far the respondents neither passed orders on the representation submitted by the petitioner nor released the vehicle allowance in favour of the petitioner.

Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation of the petitioner dated 08.01.2019 and pass appropriate orders.

Learned Government Pleader for respondents submits that the case of the petitioner would be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law.

This Court, having considered the submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of copy of this order.

With the above observations, Writ Petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
