THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10735 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of the 2nd respondent in not mutating the name of the petitioner in Municipal records in respect of House bearing Door No.16-172 and 16-173 situated in Durgamma Temple Street, Dharmavaram, Ananthapuram District on the representation of the petitioner, dated 24.04.2014, as illegal and arbitrary, and consequently, direct the 2nd respondent to mutate the name of the petitioner in the municipal records in respect of the above said properties. Heard and perused the material available on record. The grievance of the petitioner is that the petitioner has acquired the abovementioned property through a registered gift deed from his father. Seeking to mutate his name in the municipal records, the petitioner has made an application to the 2nd respondent by complying with the necessary formalities. Inspite of the same, the said representation has not been considered.

Sri Md.Saleem, learned Standing Counsel for the 2nd respondent, submitted that the application of the petitioner will be considered in accordance with law.

Recording the submission of the learned Standing Counsel for the 2nd respondent, the writ petition is disposed of with a direction to the 2nd respondent to pass appropriate orders on the mutation application made by the petitioner by duly following the procedure prescribed,

within a period of (12) weeks from the date of receipt of a copy of this order.

No order as to costs. Miscellaneous petition pending if any, shall stand closed.
