THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35489 of 2015 ORDER:

This writ petition was filed aggrieved by the inaction of the excise authorities in passing appropriate orders on the individual applications dated 05.10.2015 filed by the petitioners herein for grant of licence under Rule 5 (4) (iii) of the Andhra Pradesh Excise (Grant of Licence to Sell Toddy, Conditions of Licence and Tapping of Excise Trees) Rules, 2007.

This Court is of the opinion that this writ petition needs no adjudication as the excise authorities are yet to apply their mind to the applications filed by the petitioners.

The writ petition is accordingly disposed of directing the Superintendent, Prohibition and Excise Department, Medak, the 2nd respondent, to consider the petitioners' individual applications dated 05.10.2015 in accordance with rules and take appropriate action in the matter thereafter. This exercise shall be completed expeditiously and in any event not later than four (4) weeks from the date of receipt of a copy of this order. Pending this exercise, the subject toddy trees shall not be allotted to any third parties.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ___________________________ SANJAY KUMAR, J Date:02.11.2015 GJ
