THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.7529 of 2011 ORDER:

This petition is filed under Section 482 of Cr.P.C. to quash the proceedings against the petitioners/accused in Crime No.141 of 2011 of Khammam Rural Police Station, registered for the offence punishable under Section 498-A of IPC. Learned Public Prosecutor of the State of Andhra Pradesh submitted that the petition became infructuous as charge sheet was filed even before granting an order of interim stay. The charge sheet was filed on 19.08.2011, whereas this Court granted stay of all further proceedings in Crime No.141 of 2011, on 25.08.2011. Therefore, by the date of granting stay, no crime is pending but because of filing charge sheet, the petition became infructuous. In the circumstance, no useful purpose would be served, if the matter is kept pending. However, it is left open to the petitioners to challenge the proceedings in C.C.No.337 of 2011.

The Criminal Petition is accordingly dismissed as infructuous.

MSM, J Crl.P.No.7529 of 2011 Miscellaneous Petitions, if any pending, in this Criminal Petition shall stand dismissed.
