HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25099 OF 2017 O R D E R :

The case of the petitioner is that he was dismissed from service vide proceedings dated 03.07.1995 by the 4th respondent and against the same he filed appeal before the 3rd respondent who in turn rejected the petitioner's appeal vide proceedings dated 25.05.1996. Thereafter, the petitioner filed revision before the 2nd respondent and the same was also rejected vide proceedings dated 08.10.1998. Subsequently, the petitioner filed mercy petition before the 1st respondent on 05.01.2015 requesting the 1st respondent to reiterate him into service by setting aside the orders passed by the respondents 2 to 4. As the same is not being disposed of till today, present writ petition is filed.

Heard both sides.

The revision filed by the petitioner was rejected by the 2nd respondent in the year 1998 and the petitioner filed the mercy application in the year 2015 i.e. nearly after a period of 17 years. No reason is given by the petitioner as to why the mercy application is filed after a long period of 17 years. The acquittal of petitioner in the criminal case was also much prior to revision orders passed by the 2nd respondent rejecting the revision. It is not known why the petitioner waited nearly 17 years and filed the mercy application before the 1st respondent now.

In view of the facts and circumstances, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed on the ground of laches. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
