THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.1661 OF 2015 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 21.12.2012 passed in Crl.R.P.No.49 of 2010 on the file of the Court of the I Additional Sessions Judge, Chittoor.

Learned counsel for both parties with one voice submitted that the Revisional Court has not considered the material available on record and passed the impugned order.

Having regard to the facts and circumstances of the case and the submissions made by the learned counsel for both the parties, the Criminal Revision Case is allowed setting aside the order dated 21.12.2012 passed in Crl.R.P.No.49 of 2010 on the file of the Court of the I Additional Sessions Judge, Chittoor and the matter is remitted to the Revisional Court to dispose of Crl.R.P.No.49 of 2010 on merits, after affording a reasonable opportunity to both parties. The first respondent (husband) is hereby directed to pay an amount of Rs.1,500/- per month to the petitioners on or before 10th of every succeeding month till disposal of the revision petition. The Revisional Court is hereby directed to dispose of the matter as early as possible.
