THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.1822 of 1999 JUDGMENT:

As there was no representation for the appellant on 19.12.2017 and also on 24.01.2018 and as there was a direction already on 19.12.2017 to post the Appeal Suit under the caption "for dismissal", this Court directed the Registry to post the matter under the caption "for dismissal" on 31.01.2018. On that day, the learned counsel for the appellant sought time and, therefore, the Appeal Suit was directed to be posted on 20.02.2018 under the same caption. On 20.02.2018, this Court directed the matter to be posted today under the same caption. Today also, there is no representation for the appellant. Learned counsel, Sri M.Adinarayana Raju, appearing for the contesting respondents is present. The above conduct of the appellant reflects that the appellant is not interested in prosecuting the Appeal Suit.

In the result, the Appeal Suit is dismissed for default. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.

There shall be no order as to costs.
