HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28185 of 2005 ORDER:

This writ petition is filed challenging the orders passed in I.D.No.116 of 1997, dated 11.07.2005, wherein, no relief is granted to the petitioner. The petitioner was challenging the orders of removal before the Industrial Tribunal.

In this writ petition, the petitioner is seeking to set aside the orders of removal and reinstate him into service. A perusal of record discloses that the petitioner has attained the age of superannuation during the pendency of this writ petition and the relief sought by the petitioner to reinstate him into service may not be feasible at this point of time. Therefore, this Court is of the considered view that this writ petition can be disposed of directing the respondents to extend the service benefits to the petitioner for the period prior to his removal, if not already paid, within a period of two weeks from the date of receipt of a copy of this order. With these observations, the writ petition is disposed of. No order as to costs.
