THE HON'BLE SRI JUSTI CE CHALLA KODANDA RAM W.P.No.5458 of 2019 ORDER:
This writ petition is filed challenging the action of the respondents in granting permission to the 3rd respondent for erecting cell-tower in premises bearing No.9-14/5 situated at Sri Ram Nagar Colony, Peerzadiguda, Ranga Reddy district.

One of the ground on which the petitioner challenge is that the property to which the authorities granted permission for erecting cell-tower does not have any valid building permission. A perusal of the cause title discloses that the petitioner has not chosen to make the property owner as party respondent to the writ petition. Therefore, the petitioner has to first approach the authorities concerned, seeking information as to whether the subject property was constructed after obtaining valid permission or not and if there is no permission granted, it is open to the petitioner to take appropriate steps, as per law, if so advised.

Subject to the above observations, the writ petition is disposed of. As a sequel, the miscellaneous petitions if any, shall stand closed. There shall be no order as to costs.
