HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 33494 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is the proprietor of Vijayalakshmi Dall Mill and is doing business in pulses. It appears that the business premises of the petitioner were inspected on 18.09.2015 by the respondents and some stock was seized under a Panchanama on the allegation that the petitioner contravened the provisions of the Andhra Pradesh Scheduled Commodities (Dealers Licence Storage and Regulation) Order, 2008. The petitioner submitted an application to the second respondent on 22.09.2015 seeking release of the seized stock. When no orders are passed, the present Writ Petition is filed. The mediators report shows that the value of the seized stock is Rs.19,89,750/- . The continued detention of the seized stock pending 6-A proceedings does not serve any purpose of the State Government in any manner.

In view of the same, the second respondent is directed to release the seized stock on condition of the petitioner furnishing bank guarantee for a sum of Rs.20,00,000/-. It is needless to state that the second respondent shall dispose of the 6-A proceedings as early as possible in view of the release of the seized stock as stated supra.

Subject to the above, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ petition shall stand closed in consequence.
