HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33805 of 2016 ORDER:

This writ petition is filed for a writ of mandamus declaring the action of respondents, especially the 4th respondent in calling the petitioner and his workers to the Police Station continuously at the instance of respondents 5 to 8 and interfering in the personal life and property of the petitioner by threatening him and his workers, which is illegal and arbitrary and consequently direct the 4th respondent not to harass the petitioner by calling him to the 4th respondent Police Station.

Heard and perused the material available on record. 3.

The grievance of the petitioner is that the 4th respondent, who is the Sub-Inspector of Police, Vatsavai Police Station, Vatsavai Mandal, Krishna District, is interfering in the affairs of the petitioner in civil matters.

Learned counsel for the petitioner informed that the petitioner has already made a representation, dated 24.09.2016, to the Superintendent of Police, Machilipatnam, Krishna District (2nd respondent) about the high-handed action of the 4th respondent narrating the evil intentions and thoughts of respondents 5 to 8. 5.

Learned Assistant Government Pleader for Home submitted that the 4th respondent never interfered in the affairs of the petitioner, more particularly, in the nature of any civil dispute between the petitioner and respondents 5 to 8. Learned Additional Government Pleader further informed that the 4th respondent will not interfere with the civil dispute between the petitioner and respondents 5 to 8.

Taking into consideration the facts and circumstances of the case and the submissions of both the learned counsel, the Writ Petition is disposed of with the following direction: The Sub-Inspector of Police, Vatsavai Police Station, Vatsavai Mandal, Krishna District (4th respondent) is directed not to interfere with the affairs of the petitioner in connection with the civil dispute between the petitioner and respondents 5 to 8. This order will not stand in the way of the 4th respondent to proceed with the investigation, if any case is registered against the petitioner for cognizable offence. The Superintendent of Police, Machilipatnam, Krishna District (2nd respondent) is also directed to dispose of the complaint, dated 24.09.2016, filed by the petitioner, as expeditiously as possible, in accordance with law. 7.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ RAJA ELANGO, J Date: 17th October, 2016 KL
