THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4563 of 2018 ORDER:
This Writ Petition is filed challenging the action of the fourth respondent in threatening to dispossess the petitioner from his lawful possession of the subject land situated at Aswapuram Village and Mandal, Bhadradri Kothagudem District, at the behest of the fifth respondent.
As per the averments in the Writ Petition, the petitioner already instituted a civil suit against the fifth respondent in O.S.No.397 of 2017 on the file of the learned Special Assistant Agent to the Government and Sub Divisional Magistrate (Mobile Court) at Bhadrachalam seeking perpetual injunction.
In view of the pendency of the civil suit before the competent Court, this Court is not inclined to interfere with the said proceedings and pass an order at this stage.
The Writ Petition is, accordingly, dismissed. It is needless to observe that the dismissal of the Writ Petition is not a licence to the fourth respondent to interfere with the civil matters when the civil suit is pending before the authorities. The parties have to work out the remedies in the pending civil suit. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
