HON'BLE SRI JUSTICE S.V. BHATT W.P. No.4545 OF 2018 ORDER:
Heard Mr. Rama Gopal for petitioners and the learned Assistant Government Pleader for respondents. The petitioners challenge notice dated 24.01.2018 as illegal and arbitrary. The petitioners allege that the petitioners have given detailed reply to the show cause notice dated 24.01.2018. The cause of action or provocation for filing the instant writ petition is threatened or alleged interference without passing order or disposing of the show cause notice by Tahsildar, Visakhapatnam (Rural), Visakhapatnam District-3rd respondent.
Though a few grounds on the legality or tenability and jurisdiction of 3rd respondent to issue notice impugned in the writ petition is raised, this Court is of the view that the notice refers to one Sri Budumuri Narasimha Murthy, outsourcing driver, as the person behind the allotment of regularisation orders but without possession in favour of petitioners etc. This is a fact to be decided by 3rd respondent. For if the allegation in the show cause notice is found to be correct upon due enquiry, the same amounts to playing fraud for taking the regularisation order from the 3rd respondent. These matters are for consideration and decision by 3rd respondent. Hence, this Court is not inclined to entertain the writ petition.
The 2nd and the 3rd respondents are directed to look into the representation/ reply filed by petitioners and take a decision in accordance with law as expeditiously as possible preferably within four weeks from today.
Till a decision is taken and communicated to petitioners, subject to the conclusion that the 3rd respondent arrives in this behalf, the parties are directed to maintain status quo as on today in all aspects for a period of four weeks.
The writ petition is dismissed with the above direction. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT, J Date: 12.02.2018 Stp
