THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.18691 of 2015 O R D E R:

This writ petition is filed under Article 226 of the Constitution of India for the following relief - " That this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in nature of Writ of Mandamus directing the respondent no.2 to dispose of the appeal filed by the petitioner on 21.4.2015 preferred against the endorsement in F.Dis.(41)DTCL13022(32)/22/2015-Supdt(c)-WGO dated 5.3.2015 issued by the 4th respondent, within a time bound programme, declaring its inaction as illegal and violative of Articles 14 and 21 of the Constitution of India, and pas such other order or orders as this Hon'ble Authority may deem fit and proper in the circumstances of the case. " Heard Sri V.S.R. Anjaneyulu, learned counsel for the petitioner and the learned Government Pleaders for Home and Revenue (A.P).

According to the petitioner, he was granted gun licence by the competent authority, initially, for a period of three years vide proceedings dated 31.12.1989 and the same was extended from time to time. Validity of the licence of the petitioner came to an end on 31.12.2013 and the petitioner made an application on 13.12.2013 for renewal of the said gun licence. The 3rd respondentDistrict Collector, West Godavari District at Eluru by proceedings dated 5.03.2015 rejected the said request of

the petitioner for renewal of the gun licence. Aggrieved by the said order of rejection, the petitioner herein filed a statutory appeal under Section 18 of the Arms Act, 1962. The grievance of the petitioner herein is that no orders have been passed so-far on the appeal filed by the petitioner herein.

Taking into consideration the totality of the circumstances of the case and the nature of controversy, without expressing any opinion on the merits or demerits of the matter, I am inclined to dispose of the writ petition itself by directing the 2nd respondent to pass appropriate orders on the appeal filed by the petitioner herein on 21.4.2015, within a period of six weeks from the date of receipt of copy of this order, as per law.

Accordingly, the writ petition is disposed of. As a sequel thereto, miscellaneous applications, if any pending in the writ petition, shall stand closed. There shall be no order as to cost.
