HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.35026 of 2016 ORDER:

Heard counsel for the petitioner and the Government Pleader for Services.

Petitioner filed this Writ Petition challenging the inaction of the 1st respondent in not paying the subsistence allowance to the petitioner after the petitioner was suspended on 10.06.2016 by the 1st respondent.

After hearing the learned Government Pleader for Services on 24.10.2016, this Court recorded the statement of the Assistant Government Pleader for Services that subsistence allowance amount would be paid to the petitioner within two or three days. 4.

It is now brought to my notice that on 24.10.2016 the dues towards subsistence allowance till September 2016 were deposited in the petitioner's bank account.

However, the respondent shall continue to pay the subsistence allowance as long as the petitioner's suspension order continues. 6.

It is also the grievance of the petitioner that no enquiry officer has been appointed even though the petitioner had been suspended on 10.06.2016 by the 1st respondent. Counsel for petitioner has relied upon Circular Memo No.35676/Ser.C/98-1, G.A. (Ser.C) Dept., dated 01.07.1998 mandating that enquiry initiated should be completed in simple cases within three months and in complicated cases within five or six months.

Having regard to the same, the respondents are directed to complete the enquiry initiated against the petitioner within three months from the date of receipt of a copy of this order. 8.

With the above direction, the Writ Petition is disposed of 9.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
