HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9014 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Public Prosecutor for the 1st respondent and perused the record.

This Criminal Petition is filed to call for the records in Cr.No.191 of 2017 on the file of P.S., Huzurnagar, Suryapet District and to quash the said crime.

Having argued for some time, learned counsel for the petitioner would submit that if a direction is given in this case to the police concerned to abide by the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1, it would be sufficient and this petition may be disposed of in terms of the aforesaid decision. It is also brought to the notice of this Court that a learned Judge of this Court in Criminal Petition No.6018 of 2017 passed similar order.

Taking the facts and circumstances of the case into consideration and also the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar's case (supra), the Station House Officer, Huzurnagar Police Station, is hereby directed to follow the guidelines of the Hon'ble Supreme Court in the decision referred supra, in Cr.No.191 of 2017, so far as the petitioner herein is concerned.
