O R D E R
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction and more particularly, one in the nature of Writ of Mandamus declaring the action of the Respondent 2 and 3 in not permitting the petitioner institution into the counseling for the B.Ed Course and in not conducting a fresh round of counseling for the B.Ed Course for the academic year 2015-16 as illegal, arbitrary and unconstitutional and direct respondent 2 and 3 to conduct counseling for the B.Ed Course for the academic year 201516 by including the petitioner institution and pass any other order or orders as this Court may deem fit and proper in the circumstances of the case".
By interim order dated 15.12.2015, this Court directed as follows: "It is stated that pursuant to the interim order dated 13.11.2015 granted by this Court in W.P.No.35077 of 2015 and batch, no counselling has been held for allotment of students to the petitioner B.Ed. colleges therein. In the event any counseling is conducted pursuant to the aforestated order, the second petitioner college shall also be included in the further process of counselling." It is now stated by Sri A. Abhishek Reddy, learned counsel appearing for the second respondent Council, that as no counselling had been held pursuant to the order dated 13.11.2015 in W.P.No.35077 of 2015 and batch, the petitioner college was not included in the process of counselling and it is no longer possible to hold such counselling due to the passage of time after the commencement of the academic year. In that view of the matter, this writ petition has become infructuous and is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand
dismissed. No order as to costs.
