HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.4608 of 2015 in Crl.P.No.8306 of 2013 and Criminal Petition No.8306 of 2013 COMMON ORDER:
The defacto complainant and his Counsel Sri Asadulla Shareef are present. A.3-Syed Ali and his Counsel Sri K.S.Murthy are present.
On the report given by the defacto complainant, the Police of Bhavani Nagar P.S, Hyderabad, registered a case in Crime No.18 of 2013 against A.1 to A.3 for the offences under Sec.341, 324, 506 r/w 34 IPC and investigation is reported to be pending.
While-so, today the defacto complainant and A.3 and their Counsel present in Court and submitted that they are close friends since long time and hence at the intervention of elders they have amicably resolved all their disputes and they want to live peacefully and hence the defacto complainant has no objection for quashment of proceedings against A.3-Syed Ali and therefore, this Court may be pleased to accord permission to compound the offence and quash the proceedings in Crime No.18 of 2013 of Bhavani Nagar P.S, Hyderabad against A.3 in the interest of justice.
Having regard to the above submission and in view of the fact that the offences alleged against A.3 are
not grievous and heinous offence and further in view of their submission that the complainant and accused are close friends and known to each other and now they want to maintain cordial relationship and also considering that no useful purpose will be served even if the investigation is ordered to be continued since the parties have compromised and by following the decision reported in Gian Singh vs. State of Punjab and another[1], this petition is allowed and permission is accorded to the parties to compound the offence and proceedings in Crime No.18 of 2013 of Bhavani Nagar P.S, Hyderabad are quashed against A.3 in terms of joint memo filed by the parties.
In the result, both the petitions are accordingly allowed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
