ORDER:

On the allegation that the petitioners have encroached a public property and constructed a house forming part of premises bearing No.18-2-31/2/1/122/1, Ghazie-Millat Colony, Falaknuma, Hyderabad, respondent Nos.2 and 3 are trying to demolish the same, the former have filed this writ petition.

Though time was granted for filing counter affidavit, no counter affidavit is filed. At the hearing, Mr. J. Amrutha Rao, learned counsel, representing Mr. Pasham Krishna Reddy, learned Standing Counsel for the Greater Hyderabad Municipal Corporation (GHMC), on instructions submitted that there is no proposal for demolition of the property as at present and that in order to evade payment of municipal tax, the petitioners filed this writ petition. He has further submitted that if and when respondent Nos.1 and 2 propose to take action in respect of the building constructed by the petitioners, the GHMC will follow the due process of law of issuing a notice and considering explanation, if any, that may be filed by the petitioners. This submission of the learned counsel appearing for the GHMC is placed on record.

The writ petition is accordingly disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.39035 of 2015 shall stand disposed of as infructuous.
