This Writ Petition is filed for a Mandamus to set aside the
proceeding in R.C.No.147/2011/B, dated 07-05-2011, of respondent No.2 whereby he has suspended the petitioner's fair price shop authorization on certain allegations. At the hearing, the learned Assistant Government Pleader for Civil Suppies (AP) submitted that when the impugned order was passed, the Tahsildars were vested with the power of suspension of authorizations for a limited period of 90 days and that such a power has also been taken away thereafter. From a perusal of the impugned proceeding, it is evident that respondent No.2 has not limited the suspension period to 90 days. Even in the absence of such limit, the impugned order has ceased to remain in force on the expiry of 90 days from the date of passing of the said order. In this view of the matter, no further adjudication of the Writ Petition is necessary.
Hence, the Writ Petition is disposed of as infructuous. As a sequel to disposal of the Writ Petition, WPMP.No.17953 of 2011, filed by the petitioner for interim relief, is disposed of as infructuous.
