It is the case of the petitioner that he made an application on 10.04.2017 for grant of Occupancy Rights Certificate before the 2nd and 3rd respondents. As no action is being taken, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

It is stated in the representation dated 10.04.2017 that the name of the father of the petitioner was shown from the year 19551958. But no where in the writ affidavit it is stated that the petitioner is in possession as on the relevant date i.e., 01.11.1973 for granting of Occupancy Rights Certificate.

In the absence of any assertion in the affidavit of the writ petition and also in the absence of any evidence to show that the petitioner's father is in possession as on the relevant date, no direction can be issued to the respondents.

In view of above facts and circumstances, I do not see any reason to entertain the writ petition and same is liable to be dismissed.

Accordingly, this writ petition is dismissed. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed. _________________________ A.RAJASHEKER REDDY,J 28-04-2017 kvs
