THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.9241 of 2017 ORDER:

This petition is filed under Section 438 Cr.P.C. by the petitioner-accused No.1 seeking pre-arrest bail in C.C.No.93 of 2016 on the file of the Court of Judicial Magistrate of First Class at Palasa, Srikakulam District, arising out of Crime No.11 of of Kasibugga Police Station, Srikakulam District, registered for the offence punishable under Section 498-A IPC and 3 and 4 of the Dowry Prohibition Act.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the trial Court to dispose of the petition, if any, filed by the petitioner under Section 70(2) Cr.P.C. to recall the warrant issued against him in C.C.No.93 of 2016.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Taking into consideration the facts and circumstances of the case, the learned Judicial Magistrate of First Class at Palasa, is hereby directed to dispose of the petition, if any, filed by the petitioner under Section 70(2) Cr.P.C. to recall the non-bailable warrant issued against him in C.C.No.93 of 2016 on the same day in accordance with law.

With the above direction, the criminal petition is disposed of.
