THE HON'BLE SMT. JUSTICE G. ANUPAMA CHAKRAVARTHY CRIMINAL PETITION No.5034 of 2014 ORDER :

This criminal petition is filed seeking to quash the proceedings in Crime No.123 of 2013 on the file of Shahinayathgunj Police Station, Hyderabad registered for the offences under Sections 420, 114 and 120(b) of I.P.C. 2.

On 11.10.2022, 12.10.2022, 03.11,2022, 28.11.2022, 12.12.2022, 03.02.2023 and on 13.02.2023, as there was no representation for the petitioners, the learned Assistant Public Prosecutor was directed to report about the stage of the case and listed the matter under the caption "for dismissal". 3.

On 15.02.2023, though the matter was listed under the caption 'for dismissal' there was no representation for the petitioners and as the matter pertains to the year 2014, this Court again directed the learned Assistant Public Prosecutor to report about the stage of the case.

Today also, there is no representation for the petitioners and learned Assistant Public Prosecutor submitted that case is still pending before the court below.

Upon perusal of the record, it is evident that, Sri Mohd. Zafrullah filed vakalath on behalf of respondent No.1. It is reported by the learned counsel for the respondents that initially criminal petition No.1415 of 2014 was filed to quash the Crime No.123 of 2013 and the same was dismissed as withdrawn. But suppressing the same, the present quash petition is filed, which is not maintainable. 6.

The record further reveals that in view of the stay in this matter, no charge sheet is filed. As petitioners themselves are not evincing any interest in prosecuting the matter and as the offence is of the year, 2014 this Court is of the considered view that criminal petition deserves to be dismissed as devoid of merits. Therefore, the Criminal Petition is dismissed. Pending miscellaneous applications, if any, shall stand closed.
