THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37635 of 2015 ORDER:
The petitioners, an educational society, the educational institution run by it and the secretary of the society, are aggrieved by the action of the State of Telangana, represented by its Principal Secretary, School Education Department, first respondent, in not withdrawing the grant-in-aid staff provided to the second petitioner educational institution. The representation made in this regard by the first petitioner society is dated 01.05.2013 and was addressed to the first respondent. A copy thereof filed before this Court evidences receipt of the same by the addressee. Learned Government Pleader for Education, having received instructions in the matter, informed this Court that the said application is pending consideration.
In that view of the matter, as the authorities are yet to apply their mind and take appropriate action in accordance with law, this Court sees no necessity to entertain this writ petition at this stage and adjudicate the same on merits. The writ petition is accordingly disposed of directing the first respondent to consider the representation dated 01.05.2013 made by the first petitioner society and take appropriate action in the matter in accordance with law. In the event the request of the first petitioner society is denied, the first respondent shall pass a detailed order recording the reasons therefor and communicate the same to the first petitioner society. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
