THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20716 OF 2009 ORDER:

Heard the learned counsel for the petitioners and the learned Standing Counsel for Vijayawada Guntur Tenali Mangalagiri Urban Development Authority, Vijayawada.

2. The present Writ Petition came to be filed seeking issuance of a writ of mandamus declaring the impugned notifications issued under Section 4(1) and 6, dated 23.05.2009 and 07.09.2009 published in 'Eenadu' and 'Andhra Jyothi' Telugu Daily newspapers on 01.06.2009 and on 11.09.2009 by the 2nd respondent in proceedings R.S.G2/492/2009 respectively seeking to acquire the lands of the petitioners an extent of 10432.72 square yards situated in Sy.No.52 of Vidyadharapuram Village, Vijayawada Urban Mandal, Krishna District, Andhra Pradesh as illegal and arbitrary and set aside the same, consequently to direct the respondents to drop all further proceedings against the lands of the petitioners.

At the time when the matter is taken up for hearing, learned Standing Counsel for Vijayawada Guntur Tenali Mangalagiri Urban Development Authority, Vijayawada, placed on record the proceedings issued by the Andhra Pradesh Capital Region Development Authority, Vijayawada, which reads as under: "To Sri T.Jagadeesh Kumar, Door No.23-32-46, Paparaju Street,

Satyanarayanapuram, Vijayawada - 11.

Rc.No.IRR-APO-1254/2015 Dt.29.06.2015 Sir, Sub:- A.P.C.R.D.A., Vijayawada - Hand over of the required land for widening of IRR Phase-I for issue of TDR Bond- Requested- Reg.

Ref: Your letter dated 26.06.2015 --- With reference to your letter cited, it is to inform that the required land of 345.79 Sq.m. for widening of IRR Phase-I has to be handed over to this Authority through registered gift deed as per G.O.Ms.No.168 M.A. Rule 17(a) and court case filed against L.A. is to be withdrawn for taking further necessary action to issue of TDR Bond. Then only this office will issue TDR and land acquisition proposals will be withdrawn.

3. In view of the above proceedings, learned counsel for the petitioners submits that nothing survives for adjudication in this writ petition.

4. Accordingly, the Writ Petition is closed. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________
