ORDER:
Nobody appears for the petitioner even today, as was noticed on
22.01.2015 also.
2. The grievance of the petitioner in the writ petition is that FIR.No.577 of 2014 dated 30.11.2014 is not being investigated into by respondent No.7.
3. Instructions received by the learned Assistant Government Pleader show that the Investigation Officer already examined three witnesses. Instructions further show that the girl, stated to have been kidnapped, came to the police station along with her father and informed that she was in love with one Madhu and she went away with him on her own will and wish to Uppinavalasa village, Srikakulam District. The girl further informed that she stayed in the house of Madhu's friend and got married and she developed sexual relationship. The said statement of the victim girl was, accordingly, recorded and basing on that, Section 376(2)(n) of the Indian Penal Code was also added to the existing sections in the FIR. Both the victim girl and the said Madhu were sent for medical examination and reports are awaited. Further, on 19.12.2014, the accused surrendered before the Inspector of Police II Town Police Station and he was sent to the Court of II ACMM, Visakhapatnam, and 164 memo was also submitted before the Court.
4. Evidently, therefore, the allegation of the petitioner that the crime is not investigated is factually incorrect and the writ petition is filed without verification of facts.
Hence, the writ petition is dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
