HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.8549 of 2009 ORDER:

Heard Mr. V. Ravi Kiran Rao for petitioner and the Assistant Government Pleaders (Land Acquisition & Irrigation) for respondents.

2. The petitioner, through the instant writ prayer, prays for considering the representation dated 27.01.2009 which is in effect filed for reconveyance of land to an extent of Ac.1.21 guntas out of Ac.3.01 guntas in Sy.No.1244 at Manakondur Village & Mandal, Karimanagar District.

3. Admittedly, the subject matter of the writ petition was acquired under the Land Acquisition Act, 1894. The compensation was received by petitioner and now the petitioner prays for reconveyance on the ground that land is not put to use.

4. In view of the binding precedent of the Hon'ble Supreme Court on the power of reconveyance and right of the land owners for reconveyance, Mr. Ravikiran Rao, does not press the writ prayer.

5. The writ petition is dismissed accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
