THE HON'BLE SRI JUSTICE A. V. SESHA SAI WRIT PETITION No.22772 OF 2011 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"... to issue a Writ or order or direction more particularly one in the nature of Writ of mandamus declaring the action of the respondent No.4 to 7 in trying to discontinue the petitioners as Cooks/Implementing Agency of Mid-Day Meal Programme in respect of their schools without any notice as bad, arbitrary, illegal and violation of principles of natural justice and consequently direct the respondents to continue the petitioners as Cooks/Implementing Agencies of Mid-Day Meal Programme in their respective schools of Karimnagar district in the interest of justice."
. Heard Sri C. Damodar Reddy, learned counsel for the petitioners, learned Government Pleader for Revenue appearing for respondents 2, 4, 6 and 8 and learned Government Pleader for School Education appearing for respondents 1, 3, 5, 7 and 9.

Counter affidavit is filed by the Mandal Education Officer, Sircilla Mandal, Karimnagar District, the 5th respondent herein, stating that the respondents have not initiated any action to remove the services of the Implementing Agency and neither the respondents have threatened to discontinue the petitioners nor issued any notice to them and the allegations made in paragraph No.6 of the Writ Affidavit are not correct.
4. As evident from the tenor of the Writ Affidavit, it is clear that on the apprehension of their discontinuation, the petitioners filed the present Writ Petition.
5. In view of the categorical statement made by the
5th respondent in the counter affidavit, no adjudication is required in the present Writ Petition.
6. Accordingly, the Writ Petition is closed. However, it is open for the respondents to take action in accordance with law. However, it is made clear that since the petitioners are continuing as on date, they shall not be terminated except in accordance with law. There shall be no order as to costs.
The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
