THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO TRANSFER CRIMINAL PETITION No. 261 OF 2013 O R D E R:

None appears for the petitioner today and there is also no representation on his behalf when the matter is called.

The petitioner seeks transfer of M.C.No. 4 of 2012 on the file of the Family Court, Ranga Reddy District to any other Family Court at Hyderabad. M.C.No. 4 of 2012 has been filed by the 1st respondent wife claiming maintenance for her at Rs.20,000/- per month and for her minor son at Rs.8,000/- per month, whereas the petitioner husband filed O.P.No. 1000 of 2012 seeking divorce from the 1st respondent wife. There appears to be a memo filed in O.P.No. 1000 of 2012 by the counsel for the petitioner husband that the petitioner seeks to withdraw the said O.P. Now the petitioner submits that the respondent wife met the Presiding Officer of the Family Court at Ranga Reddy District in his chambers with her counsel and informed the learned Presiding Officer that the petitioner herein has married another lady by name Ms.

Bhaska Rani and has also shown the photographs of their marriage and some other documentary evidence in support of such a plea. Therefore, the petitioner husband, with an apprehension that the Court may have been biased against him, sought for transfer of the said Maintenance Case. The petitioner's apprehensions may not hold water any further, inasmuch as the Family Court at Ranga Reddy District is now headed by a female judge. Hence, I see no reason to transfer the Maintenance Case, which is as it is three-year-old and by transferring it to a different Family Court now, it will get further delayed. Hence, I dismiss this Transfer Criminal Petition.
