Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a permanent fair price shop dealer of shop No.15 of Pillutla Village, Machavaram Mandal, Guntur District. When the petitioner's authorization was suspended, he filed W.P.No.34818 of 2014 and the authorization of the petitioner was restored by withdrawing the earlier proceedings, by order of the second respondent dated 18.11.2014. Ultimately, the said Writ Petition was disposed of as infructuous, by order dated 20.11.2014. Later on, the stock was supplied to the petitioner March, 2015, and though he paid the amount from April, 2015, the stock was not supplied. A show cause notice was issued to the petitioner on 08.04.2015 and the petitioner submitted his explanation. However, the authorization of the petitioner is renewed upto 31.03.2016. Challenging the non-supply of the stocks from the month of May, 2015, the present Writ Petition is filed.
3. It is needless to mention that respondents 2 and 3 are under an obligation to supply the stocks until the authorization of the fair price shop dealer is in subsistence and in force. It appears that a show cause notice was issued to the petitioner on 08.04.2015 to which the petitioner submitted an explanation, but the enquiry is not completed so far. However, the petitioner's authorization is in force.
4. The Writ Petition is disposed of directing the respondents to supply the essential commodities to the petitioner so long as his authorization is in subsistence. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _____________________________________
