Disciplinary proceedings initiated against the petitioner resulted in the order of removal from service, by order 10.10.2016, passed by the District Collector, East Godavari at Kakinada. Aggrieved by the order of District Collector in removing the petitioner from service, petitioner preferred appeal to the Commissioner, Panchayat Raj & Rural Development Department on 14.11.2016. Alleging inaction on the said appeal, this writ petition is filed.

Since the petitioner has already preferred appeal, which is pending consideration, this Court is not inclined to entertain the writ petition and keep the writ petition pending. 4.

Accordingly, the Writ Petition is disposed of, directing the Commissioner, Panchayat Raj & Rural Development Department Vijayawada (2nd respondent) to consider the appeal preferred by the petitioner on 14.11.2016 and pass orders as warranted by law. A decision shall be taken and communicated to the petitioner, as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
