THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4655 OF 2018 O R D E R:

Heard learned counsel for the petitioner as well as learned Standing Counsel for the 4th respondent gram panchayat. This Writ Petition is filed seeking a mandamus to declare the inaction of the 4th respondent in granting permission for construction of a house in a plot admeasuring Ac.0.15 guntas in Survey No. 89/27 situated at Kyatanpalli Village, Mandamarri Mandal, Mancherial District, pursuant to the representation dated 23.12.2017 submitted by the petitioner, as illegal and arbitrary. The limited grievance of the petitioner is that the 4th respondent has not been considering the representation dated 23.12.2017 submitted by him seeking permission for construction of a house.

Since the relief sought for in the Writ Petition and the Interlocutory Application is one and the same and considering the nature of the relief, learned Standing Counsel submits that the gram panchayat would consider the representation of the petitioner and pass appropriate orders thereon, on merits. Inasmuch as the petitioner has already commenced the construction work, in view of the fair submission made by the learned Standing Counsel, it is directed that if there are any discrepancies that are required to be fulfilled by the petitioner, the 4th respondent shall intimate the same to him, in writing, through Registered Post acknowledgment due, giving a reasonable time, and as soon as the petitioner complies with the same, within a week thereafter, his representation dated 23.12.2017 shall be considered and appropriate orders be passed thereon. Till then, it

is needless to say, the construction made by the petitioner shall not be disturbed. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
