This petition is filed seeking for relaxation of the condition imposed by the Court of Metropolitan Sessions Judge, Hyderabad, in Crl.M.P.No.180 of 2018 in Crl.A.No.40 of 2018, dated 23.01.2018, while suspending the sentence imposed against the petitioner. The condition being that the petitioner has to deposit half of the cheque amount, which is for Rs.1,25,00,000/ -.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that the transaction between the complainant and the accused is that of the sale agreement and that the judgment of the court below also reflects that Rs.50 lakhs was already paid by the petitioner to the de facto complainant and with regard to the remaining amount he allegedly issued a cheque.

Considering the facts of the case, this court opines that the said condition can be relaxed.

Accordingly, the Criminal Petition is allowed and the said condition that the petitioner has to deposit half of the cheque amount, is relaxed.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
