THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31997 OF 2017 O R D E R:

This Writ Petition is filed seeking direction to the Police Malkajgiri not to harass the petitioner in the name of the complaint purported to have been lodged by his wife.

Heard learned counsel for the petitioner.

Learned Government Pleader for Home (Telangana) received written instructions from the 5th respondent-Station House Officer, Malkajgiri Police Station and based on the same submits that on receiving the complaint from the petitioner, a GD entry was made on 10.09.2017 and tried to contact the petitioner for counselling, but he did not turn up for counselling. He further submits that the present Writ Petition is filed on mere apprehension and to prevent the police from taking any action if any case is registered against him. He further submits that no case is registered against the petitioner and even if a case is registered against the petitioner by his wife, the respondents will strictly follow the guidelines issued in Rajesh Sharma v. State of U.P. (Criminal Appeal No.1265 of 2017.

Recording the submissions made by the learned Government Pleader this Writ Petition is disposed of. However, as this is a case of matrimonial dispute the respondent No.5 is directed to strictly comply with the guidelines laid down by the Supreme Court in Rajesh Sharma's case. If it comes to light that the 5th respondent, in the name of investigation, causes any harassment to the petitioner, he shall be liable to be prosecuted in his eo nominee capacity. There shall be no order as to costs. Consequently, the miscellaneous Applications, if any shall stand closed.
