THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35754 of 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondents 2 to 4 in not registering the crime against the 5th respondent for threatening and interfering with the petitioner's agriculture land mentioned in the writ petition, as arbitrary and illegal and consequently, direct respondents 2 to 4 to take immediate action by registering crime against 5th respondent. 2.

Heard the arguments and perused the material available on record.

The case of the petitioner is that he is the absolute owner and possessor of land in question and he raised crop in the said land. While the matter stood thus, the 5th respondent, who is no way concerned with subject property and having not succeeded in getting injunction order from the Court concerned, is interfering with the petitioner's land based on the alleged General Power of Attorney on ground that the petitioner's vendor has executed the G.P.A in his favour.

Admittedly, the petitioner has not lodged any complaint against respondent No.5 till date. If the petitioner is aggrieved over the attitude and harassment made by the 5th respondent, he is at liberty to lodge a complaint before the 4th respondent and on such application being made, the 4th respondent is directed to take appropriate action in accordance with law.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ RAJA ELANGO, J OCTOBER 24, 2016 YVL
