HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.253 of 2016 ORDER:

This petition is filed to withdraw O.P.No.921 of 2015 from the file of Family Court, Ranga Reddy at L.B.Nagar and transfer the same to Senior Civil Judge, Medak.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 08.04.2012 as per caste and customs at Baba Gardens, Kulcharam Mandal, Medak District. She stated that respondent/husband and his family members humiliated her both mentally and physically, she is now residing at Medak with her parents. she filed M.C.No.13 of 2015 seeking maintenance for herself and her daughter and she also lodged a complaint with Kulcharam Police and the same is numbered as Crime No.70 of 2015 and that she also filed a case before Junior Civil Judge, Medak under the provisions of Domestic Violence Act, all these cases are pending before the Junior Civil Judge, Medak and that respondent and his family members are attending the said Court. She stated that respondent/husband filed O.P.No.921 of 2015 before Family Court, Ranga Reddy and she prayed for transfer of that case to Senior Civil Judge, Medak to enable her to defend the case.

This Court permitted the petitioner to take personal notice to respondent through registered post with acknowledgment due and incompliance of the said order advocate for petitioner filed memos dated 29.04.2016 and 01.06.2016 stating that notice sent to respondent is duly served on respondent. Along with memo, postal acknowledgment is filed as proof of service. In spite of

service of notice, respondent neither appeared in person nor through any advocate.

4. Heard advocate for petitioner. Perused the affidavit filed in support of the petition.

5. Considering the reasons stated in the affidavit filed in support of the petition and also considering the convenience of the wife, O.P.No.921 of 2015 is withdrawn from the file of Family Court, Ranga Reddy at L.B.Nagar and transferred to Senior Civil Judge, Medak for disposal in accordance with law.
