HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7099 of 2017 ORDER:

Heard learned counsel for the petitioners/ A.2 to A.4 of Crime No.63 of 2017 of Pegadapalli Police Station, Jagitial District, registered for the offence punishable under Sections 498-A and 323 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act and also heard learned Public Prosecutor representing the State.

A perusal of the very report shows that the so called simple hurt is against the grand father of the de facto complainant by name, Chandraiah with hands by A3 and A4/ petitioners 2 and 3 herein and not any attack causing physical injuries on the de facto complainant. Having regard to the above, this is a case squarely comes within the guidelines of the reasoned expression of the Apex Court dated 27.07.2017 in Crl.A.1265 of 2017 (SLP (Crl.) No.2013 of 2017 in Rajesh Sharma & Others Vs. State of U.P. & Another) and to refer the matter to the Committee for report to consider any reconciliation.

Having regard to the above and as per the directions of the Apex Court, the Criminal Petition is disposed of while

Dr.SSRB,J directing the Investigating Officer to investigate, but not to arrest the petitioners/ A2 to A4 unless report of the Committee on its constitution is received, however this does not prevent the securing for interrogation as part of investigation.

Pending miscellaneous petitions, if any, shall stand closed.
