HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19088 OF 2016 ORDER:
The case of the petitioner is that he is the having land to an extent of Ac.4-17 cents out of Ac.6-90 cents in Sy.No.157 of Kovvur Village. While so, at the instance of the 7th respondent, a survey was conducted by the 5th respondent and a report was submitted on 11.05.2016 holding that an extent of Ac.0-13 cents of land relating to survey number 173 merged in survey number 157. Basing on the same the respondents 5 and 6 are trying to handover the land to an extent of 0.13 cents to the 7th respondent. Against the report submitted by the 5th respondent, the petitioner preferred an appeal on 01.06.2016 before the 3rd respondent along with stay petition. But the respondents without passing any orders on the same, are trying to handover an extent of Ac.0-13 cents of land to the 7th respondent. Aggrieved by the same, the present writ petition is filed. Heard both sides.
In view of the above facts and circumstances, the 3rd respondent is directed to dispose of the appeal filed by the petitioner against the report submitted by the 5th respondent on 11.05.2016 within a period of four (4) weeks from the date of receipt of copy of this order, after issuing notice to the affected parties. Till such time, status quo obtaining as on today shall be maintained by both the parties in respect of the land admeasuring Ac.4-17 cents in Sy.No.157. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
