It is seen that the respondents filed a memo dated 11.11.2010 stating that the sole appellant/plaintiff died on 1.3.2010. They enclosed a death certificate of the appellant/plaintiff. It appears no steps are taken subsequently to bring on record the legal representatives of the appellant. Hence, the appeal is abated by operation of law.

Accordingly, this appeal is dismissed as abated. No costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
