.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.762 OF 2017 ORDER :
This Court by order dated 08.06.2015 directed the respondents to permit the petitioner to withdraw 90% of the Provident fund amount as per rules. Alleging that the said order is violated, this contempt case is filed.
2.
Today the respondents report that the order of this Court is complied and the total amount of Rs.15,51,587/- which comes to 90% is paid.
3.
Learned counsel for the respondents points out that even in the affidavit filed in support of the contempt case in Paragraph No.7, petitioner himself claims that as on 01.04.2015 an amount of Rs.17,23,985.54/- was lying with the respondents and therefore, submits that the amount now paid is 90% of the said amount and therefore, the order of this Court is complied with. 4.
On a perusal of the order of this Court, it is seen that the Court has not fixed as to what is the amount from out of which 90% is required to be paid. Therefore, the payment of amount now informed by the respondents which is coming to 90% of the amount claimed by the petitioner in Paragraph No.7 cannot be said as in violation of the directions of this Court. Whether petitioner is entitled to higher amount and also entitled to interest are all matters which require consideration in the writ petition.
- 3 - 5.
Having regard to the above, the Contempt Case is closed. Pending miscellaneous petitions shall stand closed. __________________ P.NAVEEN RAO,J 31st August, 2018 Rds
