THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.14031 OF 2016 ORDER:

The present petition is filed, under Section 482 Cr.P.C., to quash F.I.R.No.180 of 2016 of Police Station Peddapalli, Karimnagar District.

2. The petitioners are arraigned as accused Nos.2 to 5 in the said crime and the offences alleged to have committed by them are punishable under Sections 498A I.P.C. and Sections 3 and 4 of Dowry Prohibition Act, 1961.

3. Heard.

4. Learned counsel for the petitioners would submit that the petitioners are parents and brothers of accused No.1, who is the husband of respondent No.2 - de facto complainant. The petitioners are residents of Rajasthan State, whereas the crime was registered in Peddapalli Police Station, Karimnagar District, and it would cause hardship if the petitioners are arrested. He seeks exemption on the ground that no concrete allegations have been levelled against the petitioners constituting the harassment said to have been meted out to respondent No.2.

5. The complaint, at this stage, contains the prima facie allegations requiring investigation. It is according to the learned counsel for petitioners that already statements of as many as five

witnesses were recorded, indicating that the investigation may be almost at the verge of completion.

6. Keeping in view, that the petitioners reside at Rajasthan State, direction is given that they shall not be arrested till the completion of investigation, with a further direction that the petitioners shall appear before the Investigating Officer and cooperate with him for interrogation purpose as and when required by the Investigating Officer.

7. Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
