THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.31437 OF 2016 O R D E R:
The writ petition is filed questioning the action of the 3rd respondent in cancelling the License of the petitioner without granting reasonable time to submit the explanation.
Inasmuch as there is an appeal provided under Section 63 of the A.P. Excise Act, 1968 (for short "the Act"), this Court is not inclined to entertain the writ petition and deal with the facts of the case. In those circumstances, leaving it open to the petitioner subject to condition that the petitioner filing the appeal within a period of four weeks from the date of receipt of copy of this order and the same shall be entertained by the Deputy Commissioner, Prohibition and Excise in terms of Section 63 of the Act and pass appropriate orders within a period of four weeks thereafter.
Subject to the above, the writ petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
