HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.32621 of 2015 ORDER:

Heard.

The petitioner states that against the order of the Chief Commissioner of Land Administration (C.L.R) Nampally in Proceedings CCLA's Ref.No.BCW1/66/2011, dated 25-01-2014, he filed W.P.No.5185 of 2014 and this Court on 04-07-2014, while issuing notice, granted interim order. On 11-08-2014, while admitting the said writ petition, the said interim order was further continued. The petitioner submits that while he is in possession and enjoyment of the land in question, the 5th respondent is not granting trees sanctioned under 'Mahatma Gandhi National Rural Employment Guarantee Scheme' in the petitioner's land on the ground that the dispute is pending before this Court in the writ petition aforesaid. Because of the said reason, in spite of making application, the 5th respondent is not granting trees in the petitioner's land.

Sri G.Seshadiri, learned Standing Counsel for the 5th respondent, on instructions, states that the petitioner is in possession of the land in question and the dispute between the petitioner and the 6th respondent is the subject matter of the writ petition referred to above. He also states that subject to the result of the said writ petition, there is no difficulty for the 5th respondent to direct plantation of trees in the petitioner's land, but the trees planted accordingly shall be available to the successful party in the aforesaid writ petition i.e., either the petitioner or the 6th respondent.

Since the learned Standing Counsel represents that the trees would be planted in the petitioner's land, the grievance of the petitioner automatically stands redressed and hence, no further orders are required to be passed in the writ petition. Accordingly, the writ petition is disposed of. No order as to costs.
