THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.118 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The appellant herein is the unofficial respondent in the writ petition. She is aggrieved by the order of the learned Single Judge in W.P. No. 46527 of 2016 dated 30.12.2016 whereby, while directing the 4th respondent herein to complete investigation and file a final report in accordance with law without arresting the respondents-writ petitioners, and they were directed to appear before the 4th respondent as and when required during the course of investigation. The appellant herein is arrayed as a respondent in the writ petition. The writ petition was disposed of even without putting her on notice and without her being given an opportunity of being heard.
On the short ground of violation of principles of natural justice, the order under appeal is set aside, and the writ petition is restored to file. The appellant shall file her counter affidavit within ten days from today. It is open to the respondents-writ petitioners to request the learned Single Judge to take up the writ petition for admission and for grant of interlocutory relief any day after ten days from today.
The writ appeal is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
