THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.709 of 2015 ORDER:
This criminal revision case is filed under Sections 397 and 401 Cr.PC challenging the order dated 26.2.2015 in Crl.M.P. No.3085 of 2014 on the file of the Court of the Metropolitan Sessions Judge-cum-Special Judge to Try Offences Under N.D.P.S. Act, Visakhapatnam.

Heard the learned counsel for the petitioners and learned Public Prosecutor.

The petitioners herein filed Crl.M.P. No.3085 of 2014 under Section 457(1) of Cr.P.C., to direct the respondent to remove the documents and other material seized in connection with Crime No.18 of 2014 of III Town Police Station, Visakhapatnam from the premises of the petitioners. The trial court, while allowing the petition, directed to the petitioners to deposit an amount of Rs.21.00 lakhs. Feeling aggrieved by the said condition, the petitioners preferred the present criminal revision case. 4.
A perusal of the record reveals that the petitioners received the amount of Rs.21.00 lakhs towards advance rent much prior to the incorporation of M/s.Bommarillu Farms and Villas India Limited. The learned Public Prosecutor, in all fairness, submitted that the respondent will vacate the premises within two months from today.

Having regard to the facts and circumstances of the case, the petitioners are directed to furnish 3rd party security for Rs.21.00 lakhs to the satisfaction of the trial court instead of depositing the same in cash.

With the above direction, the criminal revision case is allowed. Miscellaneous petitions, if any pending in this criminal revision case, shall stand closed.
