THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.13736 of 2009 ORDER :
This Writ Petition is filed seeking to issue a writ of Mandamus to declare the proceedings in Ref.H/350/2008, dated 27-05-2008 issued by the 2nd respondent herein as illegal and arbitrary and consequently direct the respondents to pay compensation for the land in an extent of Acs.5.06 cents in Sy.No.1011/3, of Atloor Village and Mandal, Kadapa District, belongs to the petitioner, in accordance with the procedure envisaged under the provisions of the Land Acquisition Act, 1894.
2. When the matter is taken up for hearing, it is brought to the notice of this Court that the Joint Collector, Kadapa, has passed order in D.Dis.(E3)/4258/2008, dated 09-032009, against the order, dated 27-05-2008 passed by the Revenue Divisional Officer, Rajampet, remanding the matter for fresh enquiry by the Revenue Divisional Officer, on the basis of the petition filed by one, Thunga Kondaiah.
In the said order the case of the petitioner was also considered and it was also specifically stated regarding the grievance of the petitioner and directed the Revenue Divisional Officer to conduct a fresh enquiry and to pass appropriate orders.
In the said order the facts and
circumstances which necessitated for remanding the matter for fresh enquiry also stated. Hence, this Court is of the view that the Writ Petition can be disposed of as follows :

The petitioner is directed to place representation before the 2nd Respondent - Revenue Divisional Officer, Rajampet, along with a copy of the order passed by this Court and also a copy of the order dated 09-03-2009 passed by the Joint Collector, seeking the necessary relief, within a period of one month from the date of receipt of a copy of the order and on such representation, the 2nd respondent - Revenue Divisional Officer, Rajampet, is directed to consider the same in accordance with law and pass appropriate orders.
4. The Writ Petition is accordingly disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition are closed. ______________________ JUSTICE RAJA ELANGO 24th February, 2015 skmr
