HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 1293 OF 2017 ORDER:
Petitioner complains against the seizure of vehicle bearing No.AP 31TT 7388 without procedure, as illegal, arbitrary and unconstitutional. Learned Government Pleader (Mines and Geology), on instructions, submits that the seizure of vehicle is on account of extraction of sand from unauthorized areas and the petitioner has to apply for appropriate orders under G.O.Ms.No.42, Industries and Commerce (Mines-II) Department, dated 29.03.2016 and after such request is made to 2nd respondent, the same will be considered and orders are passed within one week from such representation.
The statement is placed on record. Petitioner is given liberty to represent to 2nd respondent for release of vehicle within one week from today and on such representation being made by petitioner, the 2nd respondent passes order within seven (7) days from the date of receipt of copy of the representation. If the petitioner is required to comply with condition, the 2nd respondent is further directed to release the vehicle after the petitioner complies with the condition imposed by 2nd respondent.
